Cosbeautic, Inc. - Privacy Policy

This Privacy Policy (“Policy”) describes how Cosbeautic, Inc. (“Company” or “we” or “our” or “us”) treats information collected or provided in connection with an end user’s (“you” or “your” or “user”) use of the Cosbeautic’s mobile device software (the “App”) and web-based application located at www.cosbeautic.net (the “Site”, and collectively with the App, the “Service”). Please note that your use of the Service constitutes your acceptance of this Policy as set forth below:

1. Collected Information. The information collected during your use of the Service includes the following:

(a) Submitted Information. As part of using the Service, you may submit certain information to us. For example, you may provide us with an e-mail address and password as part of your user registration. You may also choose to submit your date of birth, skin tone, hair color, and gender to allow the application to better determine your settings. In addition, you may elect to post photos, comments or other content through the Service for viewing by other users. In addition, you may also choose to provide us with information, including Personal Information, through other channels such as by sending us an e-mail. “Personal Information” means information such as a name or email address that we can directly associate with a specific person or entity without additional information.

(b) Automatically Collected Information. When you use the Service, we gather certain non-personally identifiable information from you, and this information can be associated with your user account. This includes usage information, such as information on when, how often and for how long you use the Service, as well as server log data such as an IP address, browser type or the webpage you were visiting before you came to the Service. If you use a link on the Service to purchase a product through a third party, we may receive information about your purchase from such third party, such as the date of purchase and the product that you purchased.

(c) Tracking and Cookies. The Service may use cookies and similar technologies to collect information. “Cookies” are small text files containing a string of alphanumeric characters that are downloaded by your mobile device when you visit a website. Such technologies may be used, for example, to remember your user account information and your preferences, to customize the interface of the Service for you and to assist us in measuring and analyzing server traffic. Please review your browser’s documentation to learn the best way to modify your cookie settings. Like many websites, the Service does not currently respond to “do not track” browser headers. However, you can take steps to limit tracking by erasing cookies from your computer’s hard drive and by setting your browser to block all cookies or warn you before a cookie is stored.

(d) Analytics. Third party analytics service providers will receive data regarding your usage of the Service in order to provide analytics services to us. As of the date of this Policy, these service providers are Firebase, Google Analytics, Amplitude Analytics, Appboy, Algolia, and Adwords. If you elect to opt-out of data collection by these service providers (to the extent available) and subsequently use the Service through a difference device or otherwise change your cookie or privacy settings on your device, you will need to opt-out again.

(e) Social Networking Information. We may allow you to create your Service account by logging in through a social networking Service such as Facebook (“Social Services”). Integration with Social Services allows us to offer a more personalized experience to you when you use the Service. When you log into the Service using your Social Service account, the Social Service will provide us with access to certain information that you have provided to that Social Service (such as your profile picture, interests and connections), and we will use, store and disclose such information in accordance with this Policy. Please remember that the manner in which Social Services use, store and disclose your information is governed by the terms and conditions and privacy policies of each Social Service, and not the Company.

2. Use of Information. We internally use the information we collect about you as follows:

(a) Provision of Service. We may use collected information for the purposes for which you provided the information including, for example, to create and maintain an account for you or to respond to a question that you e-mail to us. We also use the collected information as necessary to provide the features and functionality of the Service to you and as reasonably necessary for our business operations. This includes posting communications you create through use of the Service for viewing by other users in accordance with the intended functionality of the Service.

(b) Updates and Troubleshooting. We may also use the collected information to contact you regarding updates or modifications to the Service or to help troubleshoot problems, provide you with required notices in connection with disputes between you and another user or alert you to changes in our policies or agreements that may affect your use of the Service.

(c) Personalized Content; Improvements. We may use the collected information to personalize the content that you and others see based on personal characteristics or preferences. We may also analyze collected information relating to your use of the Service in order to help us improve and develop the Service and other products and services.

(d) E-mail Information and Offers. We may use the collected information to provide you with newsletters, promotional materials and offers via e-mail. However, we will give you the ability to opt out of receiving such e-mails in accordance with applicable law. We will not provide your personally identifiable information to third parties for their own marketing purposes without your consent.

(e) Social Service Information. If you use a Social Service to log-in to your Service account, we may give you the ability to invite your Social Service connections to use the Service and connect you to your Social Service connections on the Service.

(f) Purchase Information. If you make a purchase from a third party retailer after clicking on a link to that retailer within the Services and we receive information about that purchase, we will use that information to personalize content as noted under Section 2(c) above, to track any payments owed to us as part of any referral or affiliate marketing relationship we may have and as otherwise descried in this Policy with respect to information we collect through the Service.

(g) Combination. We may combine personal information collected through the Service with other information that we or third parties collect about you in other contexts—such as our communications with you via email, SMS text or phone, or your customer service records.

3. De-Identified Disclosure of Information. We share and disclose the information we collect about you in a de-identified, aggregated way (meaning that no user will be specifically identified) as follows:

(a) Advertising. We may provide advertisers and other third parties with aggregated, non-personally identifiable information about our user base and its interests and usage patterns.

(b) Aggregated Data. We may report aggregated, anonymous data relating to activity on this Service to third parties or the general public. By way of example, and without limitation, this may include the provision or publication of reports regarding the geographical distribution of our user base.

(c) Business Arrangements. We may disclose non-personally identifiable information to third-party partners in furtherance of our business arrangements with them, including without limitation to jointly offer a product or service to you or create interoperability between our products and services and the products and services of such partners.

4. Disclosure of Identifiable Information. We will disclose Personal Information in the following circumstances:

(a) Transfer as Corporate Asset. In the event of a merger, sale of capital stock or assets, reorganization, consolidation or similar transaction involving Company, the information we possess, including Personal Information, shall be transferred as a corporate asset to the acquiring entity.

(b) Third-party Service Providers. We use contractors and third-party service providers to assist us in making the Service available, including without limitation third-party payment processors to pay you for your uploaded stories pursuant to our Terms of Use. Such third-party contractors or service providers may obtain access to the information you provide, including Personal Information.

(c) Legal Reasons. We will use and disclose information where we, in good faith, believe that the law or legal process (such as a court order, search warrant or subpoena) requires us to do so or in other circumstances where we believe it is necessary or appropriate to protect the rights, safety or property of the Company, our users and/or third parties. This may include Personal Information.

(d) Other Users. The Service may includes features (such as the ability to post image and comments on images) that allow you to post content that will be viewable by other users and may include your name or other Personal Information to identify you as the poster.

(e) Affiliates. We may disclose this information to our affiliates for use as described in this Policy.

5. Effective Date; Changes. When we make any changes to our practices under this Policy, we will change the Effective Date. We will treat your continued use of the Service following such change as your acceptance of the changes.

6. Third Parties. The Service may contain offers from third parties or links to third-party websites. This Policy does not apply to information that you may provide to or that may be collected by third parties, other than purchase information that may be received by us from such third parties (as outlined in Section 2(f) above). We encourage you to request such third parties to provide you with their applicable privacy policies and other terms and conditions before engaging with or making a purchase from such third parties.

7. Online Behavioral Advertising. The Service may enable third-party tracking mechanisms to collect your non-personally identifiable information for use in online behavioral advertising. For example, third parties may use the fact that you visited the Service to target online ads for Company services to you on non-Company websites. In addition, third-party advertising networks might use information relating to your use of the Service to help target Company and/or non-Company advertisements to when you visit non-Company websites. For information about behavioral advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website. The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Policy. If you prefer to prevent third parties from setting and accessing cookies on your computer, you may set your browser to block cookies. Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or of companies participating in the Digital Advertising Alliance program by opting out here.

8. Viewing, Amending and Deleting Information. To delete all data associated with your account, please email us at [email protected] and provide your user name. We may require you to take steps to verify that you are the owner of the account with that user name. Please note that while changes to your profile information are reflected promptly in active user databases, our servers may retain previously provided information.

9. Security. The personally identifiable information we collect about you is stored in limited access servers. We will maintain reasonable safeguards to protect the security of these servers and your personally identifiable information. However, no security measures are 100% effective and we cannot guarantee the security of your personally identifiable information. We expressly disclaim any representation or warranty, whether express or implied, with respect to ensuring, guaranteeing or otherwise offering any definitive promise of security in connection with your personal information or usage information.

10. Children Under 13. We do not knowingly collect information from children under 13 and the Service is not directed at children under 18. If you are a parent and believe your child under the age of 13 has used the Service and provided personally identifiable information to us through the Service, please contact us at the phone number and address provided at the end of this Policy and we will work to delete that Service account and any such personally identifiable information.

11. Transfer to the U.S. or Other Countries. Company uses facilities in the United States. Your information will be stored and processed in the United States or other countries where Company has facilities. By using the Service, you consent to the transfer of information outside of your country, even if your country has more rigorous data protection standards.

12. Your California Privacy Rights. Under California law, organizations are required to provide residents of the State of California access to a privacy policy that gives consumers a choice regarding the disclosure of their personally identifiable information to third parties for their own direct marketing purposes.
